Terms and Conditions for Rosa The Belly Dancer

Welcome to **Rosa The Belly Dancer**! By booking a performance, event, or other services provided by **Rosa The Belly Dancer**, you agree to the following terms and conditions. Please read them carefully.

### 1. **Services Provided**

**Rosa The Belly Dancer** offers belly dance performances, workshops, and related services for private events, weddings, corporate events, parties, concerts, and other occasions. The services may include solo or group performances, choreography, workshops, and any other specific requests agreed upon at the time of booking.

### 2. **Booking Process**

To book a performance, clients must:

- Submit a booking request via email, phone, or the official website.

- Confirm the event details including the date, location, time, and special requests.

- Provide a non-refundable deposit to secure the booking, as detailed in the payment section below.

- Finalize full payment prior to the event unless otherwise agreed.

### 3. **Payment Terms**

- **Deposit:** A non-refundable deposit of 50% is required to secure your booking. This deposit must be paid on the same day of confirming the booking.

- **Final Payment:** The remaining balance is due no later than the same day of the event date. Payments can be made via bank transfer or cash. 

- **Late Payment:** Failure to make the full payment by the due date may result in the cancellation of the performance without refund of the deposit.

### 4. **Cancellations and Refunds**

- **Client Cancellations:** If the client cancels the performance:

  - More than 7 days before the event: the client will receive a 50% refund of the deposit. 

  - Less than 2 days before the event: the client is responsible for the full payment, and no refund will be issued.

• If the timing of the event changes within 7 days of the performance, it could possibly be catered to at an additional cost. 

- **Performer Cancellations:** In the unlikely event that **Rosa The Belly Dancer** must cancel due to illness, emergency, or unforeseen circumstances, another dancer will do the show instead, a full refund of any paid amounts will be issued, or the event will be rescheduled to a mutually agreed-upon date.

### 5. **Event Details**

Clients must provide complete event details, including:

- **Event Location:** Address and venue details.

- **Performance Timing:** Exact start time and duration of performance.

- **Sound System:** Details on the sound system provided, or if **Rosa The Belly Dancer** needs to provide one.

- **Costumes or Special Requests:** Any special costume requests or themes must be communicated at least 2 months in advance.

### 6. **Liability**

**Rosa The Belly Dancer** is not responsible for any injuries, accidents, or damage that may occur during the performance or while traveling to and from the event. The client agrees to provide a safe performance environment and notify **Rosa The Belly Dancer** of any hazards or risks present at the venue.

### 6b. Liability and Insurance for Fire Prop Performances**

When **Rosa The Belly Dancer** incorporates fire props (such as fire head piece, fire fan veils, fire palm candles, fire sword) in a performance, the following terms apply:

#### **Safety Precautions**

- **Rosa The Belly Dancer** takes all necessary precautions to ensure the safe use of fire props during performances, including but not limited to proper training, fireproofing, and adherence to safety protocols. 

- Fire performances will only be conducted in safe, controlled environments with adequate ventilation and proper fire safety equipment available at all times. The client must confirm that the performance venue is compliant with local fire safety regulations and provide fire extinguishers, safety blankets, and a fire marshal (if required by law or venue policy).

#### **Client Responsibility**

- The client agrees to provide a safe environment for the fire performance. This includes ensuring that the performance area is clear of flammable materials or hazards and that the audience is kept at a safe distance.

- If the venue has specific fire safety rules or regulations, the client is responsible for notifying **Rosa The Belly Dancer** well in advance, so appropriate measures can be taken.

#### **Insurance Coverage**

- **Rosa The Belly Dancer** holds appropriate public liability insurance that covers fire-related performances, which includes coverage for accidents or injuries resulting from the use of fire props. However, this insurance coverage applies only to the performer and the immediate performance area.

- The client is encouraged to confirm with their own insurance provider whether they have adequate coverage for events involving fire performances. In the case that the venue or event organizer does not have insurance coverage, the client agrees to assume full responsibility for any damages, injuries, or liabilities arising from the fire performance.

#### **Indemnification**

- The client agrees to indemnify and hold harmless **Rosa The Belly Dancer**, its employees, agents, and subcontractors from any claims, damages, or expenses arising from the use of fire props during the performance, except in cases of negligence or willful misconduct by the performer.

- In the event of any injury or property damage caused by the use of fire props, the client accepts responsibility for all related costs and agrees to cooperate fully with **Rosa The Belly Dancer** and any legal or insurance investigations.

#### **Cancellations or Modifications**

- If at any point before or during the performance **Rosa The Belly Dancer** deems the fire performance unsafe due to weather conditions, venue conditions, or other factors beyond the performer’s control, the fire performance may be canceled or modified to a non-fire routine without refund of the deposit. In such cases, every effort will be made to provide a satisfactory alternative.

### 7. **Travel and Accommodation**

For events that require travel outside of Sydney, the client is responsible for the performer’s travel, accommodation, and any other related expenses. This will be agreed upon in the initial booking and outlined in the contract.

### 8. **Performance Expectations**

- **Performance Duration:** The standard performance is 30 minutes, unless otherwise agreed upon.

- **Audience Behavior:** The client is responsible for ensuring that the event space is appropriate for the performance and that guests behave respectfully. Disruptive or unsafe behavior may result in the early termination of the performance with no refund.

- **Performance Setup:** **Rosa The Belly Dancer** requires minimum 6 sqm for the performance. If no suitable space is provided, the performance may be altered or canceled.

### 9. **Photography and Videography**

The client may take photographs and videos during the performance for personal use. However, professional recording or reproduction of the performance for commercial purposes requires prior written consent from **Rosa The Belly Dancer**. Any media captured may be used by **Rosa The Belly Dancer** for promotional purposes unless the client requests otherwise at the time of booking.

### 10. **Conduct and Respect**

All performances are to be conducted in a professional, respectful, and culturally sensitive manner. The client agrees to treat **Rosa The Belly Dancer** with respect at all times and will not engage in any behavior that could be considered inappropriate or disrespectful during the event. Rosa The Belly Dancer do not accept any bookings with the intent to ridicule her talent, nor will she take on all-male bookings such as bachelor parties. 

### 11. **Intellectual Property**

All choreography, music selections, and artistic materials provided by **Rosa The Belly Dancer** are the intellectual property of **Rosa The Belly Dancer**. The client may not reproduce, record, or otherwise use these materials for any commercial purpose without explicit written permission.

### 12. **Amendments to Terms and Conditions**

**Rosa The Belly Dancer** reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes, and the updated terms will be applicable to future bookings.

### 13. **Governing Law**

These terms and conditions shall be governed by and construed in accordance with the laws of Sydney. Any disputes arising from these terms will be resolved in the courts of NSW.
